Ok, let's talk clearly: the special administrative contract is basically the "tailor's drawer" of public procurement in Spain. It is not the typical contract of works, nor of supplies, nor of common services ... This goes from strange things, those that do not fit in any category of those of a lifetime. And yes, everything is included in Law 9/2017, in case you are a fan of reading laws in your free time (Spoiler: You are not).

In its article 32, the law says something like: "Hey, if the administration wants to sign something that is not listed in the normal categories, because we call it" special "and we throw pa’lante." And now. Nothing like a generic label to get out of the way.

Examples? Come on, there are a few: contracts to exploit public goods (kiosks in parks, things like that), management of rare public services, organize shows (yes, the people of the town also count), passenger transport, do studies or research for the administration and rolls of technological innovation. Come on, the buffet free of contracts.

The fun of these contracts is that they are more flexible than a gum in the sun. The clauses can adapt to whatever it takes, as the case may be. Of course, neither is it valid: you have to follow the basic rules of the public game such as transparency, equality, free competition and those beautiful things that are great in administration's brochures.

For companies that want to put in this jungle, eye, that there is more margin to negotiate but also more browns and risks. It is not to go crazy. His thing is to have someone who knows public hiring - a lawyer, an advisor, your brother -in -law who studied law ... well, just like a real pro.

And, nothing, that if you really want to compete for these contracts, you have to be up to date with legal changes and not fall asleep in the laurels. The law changes more than the Netflix billboard.

Total, that special administrative contracts are Plan B (or C, or D) of the Administration for cases that are normal. There is flexibility, yes, but you also have to put the batteries and not lose detail. And, please, no one says I didn't know.
