Talk to a public procurement expert Shall we talk?

What types of penalties are applied by delays?

Basic Concepts

UF, delays in public contracts ... go nightmare for any company that gets into the world of tenders. It is not just that you look bad, it can cost you an eye of your face. And I don't speak only of money, yes, but the damage to prestige also hurts.

First, the famous "fines for delay." Basically, if you don't deliver things on time, they make you pay for each day of delay. Sometimes it is a percentage of the contract - imagine that they take away up to 10% just for going. And be careful, that's not the same everywhere. It depends on the city, on the local law, how the contract is drafted ... a true maze.

Now, if the company La Lía and guilt is yours, according to the Public Sector Contract Law, the sanctions can be serious. Fines that leave you trembling, or can even take from future tenders, roll "go look for work elsewhere for a few years." Not to mention losing the execution guarantee, that money that you have to put bail so that the contract is fulfilled. If you fail, goodbye to that money.

And if the thing gets ugly, the administration can cancel the contract. That is, they throw you away and look for someone else to finish the job, and you still have to load with the extra expenses that it supposes them. A jewel, come on.

Therefore, if you plan to throw yourself into the pool of public tenders, you better be clear about how the issue of delays works. It is not just a matter of goodwill, you have to put a head: to make a solid work plan, have enough people and resources, be on top of the project and, above all, talk clearly and followed with who hired you. Nothing to trust.

Anyway, that penalties are no nonsense: fines, lose bail, be vetoed, and even take away the contract and make you pay. If you do not want to end a hole in the bank account and another in the reputation, better plan well and do not sleep in the laurels.
