What regulates hiring in social services?
Let's see, the issue of hiring in social services ... This is not a "voucher, come, between whoever wants and ready." There are a lot of rules, laws and, honestly, paperwork that seeks to ensure that public money is not spent crazy. They want the process to be fair, without scams, and that people who need it really benefit.
In Spain, the queen of these norms is the Public Sector Contract Law, the famous LCSP. And if you are in another country, then they have their own version. Basically, this law puts the foundations for the entire roll of hiring services from the public, including those of social field. Define the types of contracts, how they are made, who can appear, and all that legal roll that, it can be a tostón, but it is important.
Now, social services contracts have their own section within the LCSP, VIP roll. Articles 346 to 351 focus on these services - and here not everything is just looking at who charges less. What is cool is that the law says that the quality must be valued more than the price. That is, the one who throws the price for the soils does not win, but the one that offers a decent service: accessible, continuous, easy to understand, with social responsibility, innovation and all that mandanga. Not only does it matter how much paste costs, but how work is done.
They have also tried that not only giant companies can catch these contracts. There are facilities for SMEs and third sector entities to sign up. You can divide the contracts into smaller pieces, negotiate, or even pull competitive dialogues ... it sounds like reality, but it is so that the usual do not always win.
And be careful, it is not to sign the contract and forget. Public entities have to ensure that contracts are fulfilled and, if not, sanctions can fall. There are even contracts reserved for companies that help people with disabilities or at risk of exclusion. A detail, hey.
Apart from the LCSP, there are other more specific laws in the social sector: the Social Services Law, that of dependency ... those usually put extra requirements, roll formation of user rights and others.
Total, that if you want to enter the world of public social services, prepare to read a few laws and comply with them. But well, all this, in the end, is about trying to use money well and that people receive a decent service. And yes, you have to soak up standards, but if not, this would be the wild west.
