Talk to a public procurement expert Shall we talk?

What agency solves the resources in state tender?

Appeals and Challenges

Let's see, when a company gets into the scrubbing of a public tender in Spain, sooner or later it may skip some anger with the award. You know, if "hear, this is not clear", that if "they have left me out for my face" ... the typical. And who cuts the cod in these moves? For the Central Administrative Court of Contractual Resources, or as the colleagues in the sector, the TACRC.

The TACRC is that organism that, although it sounds like a bureaucratic roll, is independent (well, enough) and depends on the Ministry of Finance. Basically, they are in charge of putting order when someone complains about how an award has gone or if he sees any type of dominant position in public contracts. Come on, that they are the referees who try to make the thing transparent and that nobody cheats in the party.

So if a company is not happy with how the award has gone and decides to pull resource, the ball goes directly to the Tacrc roof. They review the case and, if they see that the thing sings a lot, the award can knock down and force to repeat the process. Eye, not only do they serve tantrums of business: if any public agency becomes flamenco and also wants to complain, the TACRC listens to them the same.

To put an resource there, it is not to arrive and release the brown. You have to follow the steps set by Law 9/2017 of Public Sector Contracts. Deadlines, papers, requirements ... a real via paperwork, go. Therefore, companies have to be well spocked and, if they can, go hand in hand with someone who knows the subject, because getting into that garden without help is playing it.

In summary: If you are fighting for a state tender and you see that the thing smells like scorching, theirs is to know how the TACRC works so as not to lose yourself in the mess. And, honestly, it is best to look for someone to control public tenders, because here the one who does not run. And staying out for not finding out about the movie, it hurts.
